It identifies and structures the applicable laws and regulations, analyses such terms as contractual liabilities, defendant&#8217;s domicile and place of performance of the obligation. Five criteria are put forth, which must be evaluated, when deciding, whether Article 5(1) of the Regulation is to be applied, and content of said criteria is revealed.
